Terms of Service
Terms of Service
These terms apply when you order from Queen City Balloons, LLC, doing business as Queen City Balloon Bar ("we," "us"), online, in store, by phone, or by email. When you place an order or pay a deposit, you agree to these terms, our
Cancellation and Refund Policy, and our Substitution Policy.
Orders, pricing, and payment
• Prices: online prices are shown before checkout. Sales tax is added where it applies. • Quotes and estimates: once we quote a price for an order, it won't change if our regular prices change later. It can change only if you change the order. • Deposits: installations and some large orders need a deposit to reserve the date. Deposits are non-refundable. They're applied to your final balance. • Final payment: for events, installations, and orders over $250, and for all orders during graduation season, full payment is due 7 days before the event. • Changing an order: after a deposit, you can ask to change colors or items. The price and balance may change as a result. Close to your date, we can't guarantee every change. • Payment: we accept cards, gift cards, store credit, and other methods we list. Card payments are processed securely by Stripe. • Refusing orders: we may cancel any order we can't fill safely or on time. If we do, we'll refund what you paid.
Pickup, delivery, and installation
• Pickup: come in any time after your selected pickup time during business hours. Balloons are delicate, so bring a vehicle big enough to carry them without crowding. Once you pick up your order, it's in your care. • Delivery: delivery fees and service area are shown at checkout. Someone needs to be available to receive the order. If no one is there, we may leave it in a safe spot or return it to the store, and redelivery may cost extra. • Installation: you're responsible for getting the venue's permission and making sure we have access at the scheduled time. Tell us about any venue rules, such as restrictions on helium or attaching things to walls. If we can't install at the agreed time because of venue access or delays outside our control, extra fees may apply. • Outdoor events: sun, heat, wind, and rain damage balloons quickly. We'll advise you, but we're not responsible for weather damage to outdoor displays. We may decline or change an outdoor installation if conditions aren't safe.
Cancellations, refunds, and quality issues
Our Cancellation and Refund Policy sets out how much is refunded, depending on how far ahead you cancel. It's part of these terms. In short:
• Deposits and booking fees are never refunded. • Refunds are given as store credit unless you ask in writing for a refund to your original payment method. • Problems with your order: if a balloon is defective or deflates early, tell us within 24 hours and include a photo if you can. We'll replace it or give you store credit. Damage caused after pickup or delivery, such as popping, heat, or sharp objects, isn't covered. • Substitutions: occasionally a color or item runs out. Under our Substitution Policy, we'll replace it with the closest match available and contact you first when a change is noticeable. • If we cancel: if we cancel for reasons within our control, you choose a full refund, including the deposit, or a free reschedule. If we cancel for reasons outside our control, we'll work out a fair solution with you.
Balloon safety and float times
• Choking hazard: children under 8 can choke or suffocate on uninflated or broken balloons. Always supervise children, and throw away broken balloons right away. • Latex: many of our balloons are made of natural latex. If anyone at your event has a latex allergy, tell us when you order so we can suggest latex-free options. • Foil balloons: foil balloons conduct electricity. Keep them away from power lines, and never let them go outside. • Never release balloons: please pop and throw away balloons when you're done with them. • Helium: don't inhale it. • Float times are estimates: we test float times carefully, but heat, cold, sunlight, air vents, and handling all affect how long a balloon floats. The float times we list are typical results, not guarantees. Gift cards and store credit • Gift cards belong to whoever has the card number, so treat them like cash. They never expire and can't be exchanged for cash, except where the law requires. We can't replace a lost or stolen card, though we'll help if you report it before someone uses it. Some cards need a PIN to spend online. You never need a PIN in store. • Store credit is tied to your customer account. It can't be transferred or exchanged for cash.
Rewards program
• Earning points: you earn points automatically on purchases. Points are based on the amount before tax, and installation charges count. Delivery fees, gift card purchases, and purchases paid by trade don't earn points. • Rewards: points can be redeemed for rewards we list. A reward covers the item's base price. Add-ons and upgrades are charged normally. • Reward tiers: Bronze, Silver, and Gold status are based on the total points you've ever earned from purchases. Once you reach a tier, you keep it. Each tier gives a permanent discount and a one-time gift. The tier discount starts with your next order after you reach the tier. It doesn't combine with discount codes; you get whichever is better. • Birthday club: members and their family members get a birthday gift during their birthday month. You must join at least 30 days before the birthday. • General: points, rewards, and gifts have no cash value and can't be transferred or sold. We may change or end the program. If we do, we'll give reasonable notice and honor rewards you've already earned. We may remove points earned by mistake, through returned or refunded purchases, or through fraud.
Rentals
Rental items are covered by the rental agreement you sign, which comes first if it conflicts with these terms. You're responsible for rental items from delivery or pickup until we get them back.
Photos and designs
• Photos: we may photograph our work at your event and share the photos in our portfolio and on social media. If you'd prefer we don't, tell us and we won't. • Our designs: our designs, mockups, product photos, and website content belong to us. Don't copy them for commercial use. • Colors and previews: colors can look different on screens, and design previews are illustrations, not exact layouts. Finished pieces will vary slightly in arrangement and size.
Using our website
Keep your account login private. You're responsible for orders placed through your account. Don't misuse the website, for example by trying to get around pricing or security, scraping it, or submitting false orders. We may close accounts that do.
Limits on our liability
As far as the law allows, our total liability for any order is limited to the amount you paid for it. We're not liable for indirect losses, such as the cost of a rescheduled event. We're also not liable for delays or cancellations caused by events outside our control, such as severe weather, power outages, or supply shortages, including helium. Nothing in these terms limits rights you have under law that can't be waived.
Governing law
South Dakota law governs these terms. Any dispute will be handled in the state courts of Minnehaha County, South Dakota. Before going to court, contact us so we can try to resolve it first.
Changes to these terms
We may update these terms. The version posted when you place an order applies to that order.
